LUMMUS, Justice. This is a complaint to a district court, charging that the defendant did distribute hand bills in a public street, she * * * not then and there having a permit to do so. She renewed in the Superior Court on appeal a motion made in the District Court to quash the complaint for the reason that the offense charged against the defendant is unknown to law. The only point argued upon the motion is that the complaint did not set forth the ordinance, and allege that the act charged was contrary thereto. An ordinance of the city of Fall River, the Commonwealth admits, is the sole foundation of the complaint.
