Article 11 of the Declaration of Rights of the Massachusetts Constitution gives the defendant in a criminal case a right to a speedy trial even if he is in prison serving a sentence for another crime. [387] The constitutional right of the defendant in a criminal case to a speedy trial is a personal one and may be waived, and is waived by implication through failure to demand prompt trial in the absence of circumstances negativing such implication.
