Where it appeared that the Judge at a criminal trial had only a minimal evidentiary basis for his Conclusion that the defendant was competent to stand trial, and that the Judge may have misapplied the burden of proof on this issue, this court reversed the defendant's conviction of assault with intent to commit rape.
